Practical Tools for National Implementation: Implementation of EU Policies at National Level

Target group:
Officials and experts from ministries, central agencies and authorities responsible for drafting, coordinating and implementing European Community legislation at the national level.
Description:
The seminar will focus on specific issues concerning political, legal and project managerial aspects of implementing EU law at the Member State level; including the identification of different legal instruments, planning, timing, consultation, allocation of responsibilities, communication, enforcement, etc. Workshop sessions will give participants the opportunity to exchange experiences and views on successfully accomplished processes, obstacles encountered etc. The seminar also illustrates the need for and consequences of no- or incorrect implementation. Our aim is to give participants a better understanding of national as well as the Commission’s needs when implementing European Community legislation.
Objectives:
The objectives of the seminar are:
- To transfer methodology and tools as well as creating awareness to ensure compliance with EU membership obligations;
- To discuss the balance between domestic and supranational political interests, and constitutional and legal requirements
- To learn by exchange of experiences with other countries

Linking EU and national legislation
Treaty obligations regarding implementation and what needs to be implemented, self-imposed legal obligations (acquis) and definitions and structure of EU legal acts will be reviewed and discussed.

Workshop I - National processes of implementation and stakeholders
Who does what and when – Involvement of national governments, NGOs and local and regional governments in dealing with the EU. Participants will be asked to identify national tasks, stakeholders and sources for information.

Notification instruments
Upon completing the national law approximation process, Member States must inform (i.e. notify) the Commission or the Council Secretariat of the result. There are various notification instruments, but when should one use one or the other of these? Through practical examples, this session will link the choice of EU legal instrument with the appropriate notification instruments and documents informing the Commission of legislation implemented.

Workshop II- Analysing legal acts
The participants will be divided into groups and be asked to analyse legal acts (regulations, directives and decisions) in relation to obligations, time limits, organisational requirements, etc.
The results of the workshop will be discussed in plenary.

The participants will be divided into groups and be given different tasks. Each group will be asked to present a plan for implementing an EU legal act. They will also be asked to identify problems and come up with solutions.

Public Transport: Luxembourg City has two main bus stations, one in the city centre called “Centre Aldringen” and one next to the railway station called “Air Terminus”. All buses, wherever they go, are passing through these two stations. Bus no 18, with departure every ten minutes, is going direction Kirchberg, stopping right in front of Hotel Novotel, which is at walking distance to all European Institutions.
Meals: The lunches will be served at the Amarine’s restaurant- 5 min walk from EIPA and the reception in the Chambre des Métiers building. Should you require a special menu (e.g. vegetarian, diabetic), please inform the Programme Organiser so that this can be arranged.
Participation: The fee applicable to each activity is clearly indicated on the registration form. Unless stated differently on the registration form, the fee includes participation in the activity, lunches and beverages during the activity, documentation and participation in the reception/cocktail. Travel and accommodation costs are at the expense of the participant or his/her administration. Pre-payment of the fee is a condition for participation in an activity. Prior to the activity each participant will receive an invoice which can be paid by bank transfer or by credit card.

Cancellation policy: EIPA reserves the right to cancel the seminar up to 2 weeks before the seminar starting date. In that case, registration fees received will be fully reimbursed. EIPA accepts no responsibility for any costs incurred (travel, accommodation, etc...). For administrative reasons, a fee of € 150 will be charged for cancellations received after 14th of September unless another participant is designated. The mention of a speaker’s name in the programme does not commit EIPA.
